Here is our legal identity.

American Catholic Press is a not-for-profit corporation of the State of Illinois. Like a church, school, or hospital, it is a 501 [c] 3 organization under the Internal Revenue Code. Hereinafter, American Catholic Press is also identified as ACP, ACP Publications, we, us, and our. American Catholic Press may also be identified by one or more of its affiliates, such as ACP Family Bookstore and Apex Custom Printing. By its Articles of Incorporation, set up in 1972, American Catholic Press exists to foster the good of the liturgy, academic research and instruction, and the spread of Christian culture. We do not control sites linked to us.

We have two home sites: acpress.org and acppublications, where you are right now. As a service to you, our home sites provide many hyperlinks to other linked sites, sometimes an interface to these sites. Please note that ACP has no control over the appearance or the content of these linked sites. ACP assumes no responsibility or liability for anything presented on these linked sites, whether appliances, books, CD's, magazines, news, opinion, publications, quotations, recordings, services, tapes, utensils, videos, wombats, xysters, yaks, zebus, or anything else. ACP's providing access to such linked sites does not imply any endorsement of the materials, products, or services on those linked sites, nor any association with their operators.

To be sure, we trust that you will find the links we provide to be a benefit, in accord with your own interests and needs.


We can change our own sites or interfaces.

ACP reserves the right to alter or delete material, at any time without notice, from its home sites or from its interfaces with linked sites. It is also possible, at any time, that a given site, interface, or linked site will not be functioning well or not at all. ACP makes no guarantee that its own sites, interfaces, or linked sites will not cease functioning or will provide only interrupted service. Such mishaps may occur because of electrical storms, solar flares, fire, flood, server failure, virus attacks, operator error, software malfunction, Islamic Jihad, or any number of possible and unforeseen causes. ACP therefore reserves the right to shut down sites or interfaces for necessary or appropriate maintenance, as required, or to make whatever changes or adjustments are needed, without notice or warranty of any kind.

Deming

In general, we do our best to follow the management principle of W. Edwards Deming known as continuous improvement. Always, your suggestions are welcome and appreciated. We are at your service.






Nemo dat quod non habet.

Any offers of any kind are subject to availability. For example, you may order a book from the ACP Family Bookstore that has the notice online Out of Stock. If you order that book, it is not available in our six giant warehouses, located across the United States. Your order will be cancelled. If you order several books, one of which is Out of Stock, your entire order may be cancelled. If, however, you come back in a week or so, it is possible that the book you want will again be on the shelf. In an inventory of two million books, individual titles are regularly going out of stock and being replenished. It is a huge operation, to give you the best selection possible, with efficient delivery.

UPS

If you purchase something from any of our home sites or linked sites, you will then be shipped whatever you ordered, probably by United Parcel Service [UPS] or the United States Postal Service, the carrier. All items that are purchased in this way are purchased pursuant to a shipment contract, as is customary with many online services as the same nature as ACP. With such a shipment contract, you agree that the risk of loss and title for items purchased pass to you upon their delivery to the carrier. Once the item leaves here and is on its way to you, it's yours.

By law, UPS cannot deliver to a post office box. A physical, street address is required. UPS also cannot deliver to incorrect addresses nor to locations where no one is present to sign for the delivery. In such cases, after three unsuccessful attempts, the book or other product which you already own will be returned to the sender. You may then pick it up there, if that is ACP, or pay a second time to have it shipped out to you at a correct address, where someone can sign for delivery. On the one hand, if you have given us an incorrect address or an address where no one is present to sign for delivery, no refunds or credit of any kind will be given to you. On the other hand, for the ACP Family Bookstore, if you provide a Post Office Box as your address, your shipment will go out by means of the U.S. Mail. In either case, we will give you the best service we can.


Terms and Conditions

The following is not a complete statement of our terms and conditions. Further elements may be found elsewhere on this website, our related or affiliated websites, our interfaces, in letters, phone calls, emails, faxes, or other communications from ACP.

ACP also reserves the right to decline service to anyone for any reason at any time. For example, ACP may decline service to entire municipalities or countries, especially overseas, as it seems to be appropriate to ACP, in its sole judgment and discretion.

If any of our terms, conditions, or policies shall be deemed invalid, void, or, for any reason, unenforceable, then that term, condition, or policy shall be deemed severable. In that case, there shall be no effect on all other terms, conditions, or policies, which remain in force. All our terms, conditions, and policies are subject to the laws and courts of the State of Illinois, where any disputes are to be adjudicated.

Your privacy is important to us. As a part of our service to you, information you provide us will not be resold, rented, or licensed to any other organization.

Also, for your benefit, from time to time, ACP will make available discounts and special offers. At your request, we may also provide special searches and other services to you. All discounts, prices, terms, conditions, and policies of ACP are subject to change without notice, at any time, at the sole discretion of ACP.

No returns can be accepted on videotapes, cassettes, CD's, DVD's, special orders, custom printed items, used books, or print-on-demand books. In general, these items cannot be resold. However, with the explicit approval of ACP's manager, we may accept returns on regular book orders, within 20 days of the placement of the order, at the sole discretion of ACP, without condition or warranty of any kind. Acceptable refunds apply, not to shipping or handling expenses, but only to the purchase price of the book itself, as is customary with most bookstores. In general, with such refunds, a restocking fee will be applied, to cover the costs involved, as is also customary with bookstores.

In all such matters, our goal is your complete satisfaction. We will always do our best for you.


Intellectual Property: Trademarks and Copyrights

All trademarks mentioned or cited are the property of their respective owners. Leaflet Missal is a registered trademark of ACP Publications. See our separate disclaimer for the expired trademark Monthly Missalette.

Also, we have done our best to respect all known copyrights. If anything in our home sites is copyrighted by anyone else, please tell us; we will set things right immediately. Nothing in our home sites or linked sites should be construed as granting, by implications, estoppel or otherwise, any license or right in and to any trademarks or copyrighted material, without express, written permission of the owner.

Any emails, letters, notes, or other communications sent to ACP become the property of ACP and may be used for any good purpose whatsoever, in the sole judgment and discretion of ACP. Such communications may be edited for reasons of brevity, style, or any other motive, in the sole judgment and discretion of ACP. If you wish to retain anonymity in any printed or online publication, please let us know. In any case, we are happy to hear from you.

Our two home sites and our interfaces to linked sites contain proprietary information including but not limited to text, photos, logos, and graphics. ACP holds a copyright on all this material, as a collective work, especially in the selection, coordination, arrangement, and enhancement of content, as well as original content. Therefore, you may not modify, publish, transmit, transfer, sell, disseminate, or in any way exploit any of the content to which we claim a copyright. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or exploitation of downloaded material will be permitted without the explicit permission of ACP. In the event of any permitted copying, redistribution, or publication of copyrighted material, there shall be no alterations in or deletion of author or composer attribution, trademark legend, or copyright notice. You acknowledge that by downloading copyrighted material you do not acquire any ownership rights. Of course, for use in your own home, that is, for personal use, you may download and print out copyrighted material, according to your own needs. We are here to serve you.

Moreover, ACP provides its two home sites and interfaces with linked sites on an as-is and as-available basis. With regard to the operation of these home sites, interfaces, or linked sites, ACP makes no representations or warranties of any kind, expressed or implied. Specifically, there is no implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. ACP does not warrant that these home sites, interfaces, or linked sites, their servers, or emails sent to you are free of bugs, Trojan horses, viruses, worms, or other harmful components or programs. You make use of our home sites, interfaces, and linked sites entirely at your own risk. ACP also does not warrant that its home sites, interfaces, or linked sites will be uninterrupted or error free. There may be factual inaccuracies, incorrect references, dead links, wrong citations, or typographical mistakes. Any corrections you pass on to us will be gratefully received.

In no event will ACP or anyone else involved in creating, editing, or producing our home sites, interfaces, or linked sites be liable for any damages related to or arising from use of ACP's home sites, interfaces, or linked sites, without any limitation.
